1) Saambaa Platform
a) The application you downloaded is powered by and published by Saambaa. Saambaa provides branded mobile application publishing services for its “Partners” on the “Saambaa Platform”. Therefore, in all cases below, the term “Saambaa” is meant to describe Saambaa, its licensors or any Partner of Saambaa that chooses to publish branded apps on the Saambaa Platform.
b) If you have downloaded a Partner-branded application published on the Saambaa Platform (such as the Partner application you downloaded here), that Partner has mutual rights to the data you provide by using that Partner’s application as described below.
2) Saambaa’s Privacy Policy
a) Non-Personal Information
i) Information: Saambaa and its Partners intend to serve advertising within the Saambaa Platform. However, we will NEVER give your personally identifiable information to these companies without your expressed consent. We have a security wall between personally identifiable information (name, contact info, etc), and non-personally identifiable information (interests, activities, etc). In order to serve advertisements in the aforementioned manner, Saambaa may provide links to third party websites or allow other companies, called third-party ad servers, to display advertisements to you. We may share or disclose your non-private, non-personal information without disclosing anything about who that information is attached to. We may also track the number of users who clicked on a particular link (even if only one did), or we may share data in the aggregate (e.g. statistics).
ii) Overall consent: Your use of Saambaa assumes your consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information. Regardless of which country that you reside in or create information from, your information may be used by Saambaa in the United States or any other country where Saambaa operates.
iii) Log Data: When you use Saambaa, our servers automatically record non-personally identifiable information ("Log Data") created by your use of the Services. This information helps us figure out how users in general are using the site, so we can make adjustments to improve the Saambaa experience. Log Data may include information such as your IP address, browser type, the referring domain, pages visited, and search terms. Other actions, such as interactions with advertisements, may also be included in Log Data.
iv) Cookies: Like many web services, we use "cookie" technology to collect non-personally identifiable website usage data and to improve our services. A cookie is a small text file containing a string of alphanumeric characters - to administer our services and provide a more tailored and user friendly service to you. For example, we may use cookies to count the number of unique users accessing our services. Saambaa may use both session cookies and persistent cookies to better understand how you interact with our services, to monitor aggregate usage by our users and web traffic routing on our services, and to improve our services. Most Internet browsers automatically accept cookies. You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, some features of Saambaa may not function properly if the ability to accept cookies is disabled.
v) Third Party Services: Saambaa uses services such as Google Analytics to help understand use of our Services. Through Google, Analytics collects non-personally identifiable information sent by your browser or mobile application as part of a web server request, including cookies and your IP address. Google also receives this information and their use of it is governed by their Privacy Policy.
vi) Information received through APIs: Saambaa may receive your information through various web sites, APIs, services and third-parties. Saambaa would only receive this information if you provided expressed consent to these third-parties.
b) Personal Information
i) Personal responsibility: You are responsible for your use of the Services, for any content you post to the Services, and for any consequences thereof. The Content you submit, post, or display will be able to be viewed by other users of the Services and potentially through third party services and websites if you provide consent for them to access. You should only provide Content that you are comfortable sharing with others under these Terms.
ii) Default settings
(1) Profile and postings: We give you settings to make your information on Saambaa private. We may, however, offer options to make your information public for other users to see. If so, your public information, including profile information and postings, would be broadly and instantly disseminated unless made private. It is also likely that your intended destinations will be made public if you do not adjust privacy settings. In some cases you will not be able to make your destinations private from 1st degree friends. You may also disclose your current location; you will be able to control location information in the service.
iii) Service Providers: We engage certain trusted third parties to perform functions and provide services to us. We may share your personal information with these third parties, but only to the extent necessary to perform these functions and provide such services within the context of our Site and its related communications, and only pursuant to obligations mirroring the protections of this privacy policy. We also may share non-personally-identifiable information such as broad user statistics for research, or interest keywords so we may better serve targeted advertising. For instance, we may share your non-personally-identifiable information with advertisers, such as your interest in photography, to show you ads for camera equipment, but we do not tell the camera equipment company whom you are.
iv) Law and Harm: We may disclose your information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Saambaa’s rights or property.
v) Business Transfers: In the event that Saambaa is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. The promises in this privacy policy will apply to your information as transferred to the new entity.
c) Policy towards children
i) Minimum age: Our Services are not directed to people under 13 years old. If you become aware that your child has provided us with personal information without your consent, please contact us at questions@saambaa.com. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to investigate, remove such information or terminate the child's account.
d) Termination of your account
i) Should you choose to terminate your account, we will wipe our records of all personally identifiable information you have provided us. However, previous postings and activities attributed to you in our system may still remain visible to others (according to your privacy settings at such time). We may also keep record of your interests and activities on the site through non-personally identifiable ID tags.
3) Definitions
a) By "Saambaa" we mean the features and services we make available, including through (a) our Partners’ mobile applications; (b) our website at www.saambaa.com and any other Saambaa branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions); (c) any electronic communications generated by the Saambaa Platform; and (d) other media, software (such as a toolbar), devices, or networks now existing or later developed.
b) By "us," "we" and "our" we mean Saambaa LLC and Partners of Saambaa LLC who are using the Saambaa Platform.
c) By "post" we mean a post on the Saambaa platform or a post otherwise made available to us.
d) By "use" we mean use, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.
e) By “personally-identifiable information” and “personal information,” we mean any information that could be used to locate and contact you directly, such as your real name, phone number, address, email address, and instant messenger screen names.
f) By “non-personally identifiable information” and “non-personal information,” we mean all information other than “personal information,” such as your interests, activities, and comments.
